MEDIATION AT MAGNUS LAW
In BC, litigation and legal disputes are increasing being resolved through alternative dispute resolution mechanisms such as Mediation. While at Magnus Law we have prided ourselves as advocates and litigators, we recognize that not every problem should be resolved in Court. As such, we provide mediation services. Duncan Magnus is an Associate Mediator on the Mediate BC Mediator Roster.
WHAT IS MEDIATION?
Mediation is a popular mechanism to resolve disputes through facilitated discussion.
Mediation is a process by which a neutral third party facilitates discussion to help the parties resolve a dispute through negotiation, interest based discussion, identifying barriers, focusing on solutions and creative thinking.
WHY MEDIATION?
- Mediations are confidential
- Mediations are without prejudice meaning that what is said cannot be used in court
- A mediator can help both parties focus on what truly matters to them
- It is less adversarial which leads to a better chance of preserving relationships
- It can allow for more flexible and creative solutions than a litigated outcome; avoiding the win/loss dichotomy of litigation
